Synchtank Limited and its subsidiaries (henceforth referred to as “Synchtank”) is committed to protecting the privacy of its users and therefore, before providing any information about yourself or another person, we recommend you read our Privacy Policy. 

This Policy covers how and why we collect personal information about individuals who use the Synchtank systems as well as those making enquiries about the use of Synchtank. This policy explains how we use the information we collect as well as how we protect that information and keep it secure.

Who we are

Synchtank is an online IP and content management system for music companies.

GDPR

The General Data Protection Regulation, or GDPR, is a European privacy law. The GDPR regulates how individuals and organisations may collect, use, and retain personal data, which affects Synchtank and sites run on the Synchtank platform.

Who is affected by GDPR?

The General Data Protection Regulation (GDPR) affects companies and organisations that collect, store, or manage personal data of people in the European Union (EU) or target people in the EU.

EU-based organisations

Any company or entity that processes personal data of EU residents, regardless of where the data is processed 

Non-EU organisations

Any company or entity that offers goods or services to EU residents, or monitors their online behavior 

The GDPR also applies to the UK, even though the UK left the EU in 2019. The UK General Data Protection Regulation (UK GDPR) applies to:

  • Organisations operating in the UK
  • Organisations outside the UK that offer goods or services to people in the UK 

The GDPR gives tech users rights like access and control over their data, and the ability to request that their data be deleted. It also requires organisations to use security tools like encryption to minimise damage to users in the event of a data breach.

Key Terms

The term ‘personal data’ used henceforth, refers to any information that relates to you and could be used to identify you, either directly or in combination with other data we might store (outlined below in the section entitled ‘The information you give us’).

In our Privacy Policy, the term ‘Clients’ used henceforth, refers to individuals who have purchased or are trialing the Synchtank system and includes those visiting the Synchtank site. The term ‘End Users’ refers to individuals unconnected to Synchtank who are users, visitors or customers on a Client’s Synchtank system.

By continuing to use this Website, you consent to your information being processed in accordance with this Policy.

The terms ‘we’ ‘us’ or ‘our’ used henceforth refers to Synchtank Limited and all its subsidiaries.

What information do we collect from you and how do we collect it?

  1. The information you give us

You may give us personal data when you use our website or correspond with us. You may give us information where we request it from you, or when filling out forms such as the ‘contact us’ form. You may also choose to provide us with additional information when you contact us.

You may choose to trial or purchase our Synchtank software. The information you provide when setting up the system includes your name, email address, business name and type, business address and payment type. Please be aware that we do not store your payment information, this will be done via a third-party payment company such as PayPal or Stripe. You will also have to create a password to be able to access your content.

You may choose to create a User Account for yourself or another person. The information you provide when creating this account includes, name, email address, country, state (if applicable) and social media links as well as any other information you wish to provide when creating an account. You will also need to create a unique password to be able to access the account.

  1. The information we collect automatically

When you visit our Website, we may automatically collect the following information: your IP address, log-in information, location information, browser type and version, browser plug-in types and versions, operating system and platform, information about your visit including the URL clickstream to, through and from our Website, products you viewed or searched for, download errors, length of visits to certain pages and page interaction. We collect information automatically through the use of various technologies, including through cookies (outlined in the section below). Note that to ensure the optimal functioning of our site we use some third-party tools which may store and track personal data to ensure the optimum running of your site, these include Google Analytics, HubSpot and RB2B.

Cookies

Cookies are a small amount of data sent to your browser from a website. Each device that accesses our website will be assigned a different cookie.

When you visit or log in to our website, cookies and similar technologies may be used by our online data partners or vendors to associate these activities with other personal information they or others have about you, including by association with your email or home address. We (or service providers on our behalf) may then send communications and marketing to these email or home addresses. We also use cookies to recognise your device and provide you with a personalised experience of the Synchtank systems, adjusting language or currency based on your location for example. They also enable us to measure website traffic information, such as the number of visits a page receives.

You can delete or disable cookies using your browser’s menu but be aware that some functionality may be limited if cookies are disabled.

Newsletters and Marketing

If you choose to subscribe to the Synchtank Newsletter and Marketing emails, we will store your email address in order to send you posts from our blog, news, and other articles. You may also receive the occasional marketing email in order to keep you informed of our services. We do not share any of this data with third parties. You may unsubscribe at any time by clicking the unsubscribe link in the emails we send out.

How does this Privacy Policy apply?

This Privacy Policy describes what we do with the personal data that we collect and use for our own purposes, such as a Client’s email address or name.

As a company we also host and store User Data for our Clients. Our Clients inform us of what they wish to do with the personal data and we follow these requests. Thus, this Privacy policy does not define what Clients do with an End User’s personal data. If you are an End User of one of our Clients’ sites and want to know how a Client is handling your personal data, you should refer to their privacy policy.

If you are a Client, End Users need to be made aware of what you do with their personal data. As such upon using our systems, you agree to post a current and accurate Privacy Policy on your Synchtank system detailing how you use End Users’ personal data in accordance with your local laws. You also agree to ensure that your Users have consented to the use and access of their personal data in accordance with regulations.

Synchtank is not liable for a Client’s relationship with their Users or how a Client chooses to use such personal data.

If you are a Synchtank Client and you wish to update your Privacy Policy on your system, please go to Admin > Website Management > Pages > Privacy Policy.

How we use your personal information

  • to provide you with the information and services you require;
  • to ensure that the content for our sites is presented in an optimal manner for you;
  • to administer our site and for internal business administration and operations, including troubleshooting, data analysis, testing, research and statistics;
  • to give Clients access to a User’s data as per their request and in compliance with this policy; this is so Clients can analyse the usage of their system and improve their services;
  • to notify you about changes to our service;
  • as part of our efforts to keep our site safe and secure;
  • to comply with legal requirements, such as tax and other governmental regulations; and
  • fraud prevention.

Sharing your personal information

Synchtank will not sell or share your data with other third parties, except in the following cases:

  • If the law requires it;
  • If it is required for any legal proceeding; or
  • To prove or protect our legal rights.

Synchtank does not share your personal data to advertisers or marketing companies. In rare cases, we may share your personal data for administration and troubleshooting purposes with integration partners (such as PayPal or Stripe for billing purposes).

Keeping your information safe  

All your personal data is stored on secure and encrypted database systems and the access to the data is limited to qualified personnel for support purposes only. All passwords are stored in one way hashes and cannot be read by Synchtank or any of its employees. All Synchtank systems undergo regular penetration testing to ensure maximum security. Logs are reviewed on a regular basis to detect any suspicious behavior. All our websites are run over secure connections using https.

Your Rights as a Synchtank Client

Where applicable law applies, as a Synchtank Client you have the right to access, update, change and delete your own personal information, either directly on your Account or User page or by contacting the support email address below.

Similarly, Synchtank Clients can also update, alter and delete the personal data held about your End Users on your own Synchtank platform directly on your Account or the User page or by contacting the support email address below. You can also choose to delete your Synchtank system at any point by contacting that same support email address. We will endeavor to respond to your deletion request within an appropriate time frame including those enforced by law. As a Client you are responsible for managing your End Users’ requests for access, alteration and deletion of their personal data.

If you are a Synchtank Client who wishes to obtain a copy of your own personal data, please contact us. We may ask for verification of your identity before providing further details.

If you are an End User of a Synchtank platform and wish to obtain a copy of your personal data, please contact the Synchtank Client directly.

It is your responsibility to ensure that all data held by Synchtank is true and accurate, you can update your Account information at any point on your User page. You can also update your personal information by contacting us where we may ask you to verify your identity before proceeding.

We will retain the personal data regarding our Clients as long as you use our system or as long as necessary to fulfill the purposes described in this Privacy Policy, for example, to comply with our legal obligations and to prevent fraud. We reserve the right to continue to hold personal data where it is needed in order to fulfill our contractual arrangement with you or where we may have a legitimate interest in doing so.

Be aware that we may continue to store anonymous information such as page visits without any identifiers in order to improve our service.

Personal data as a User

Our Clients who have purchased a Synchtank system are responsible for how they use the personal information they collect, either directly from an End User or through Synchtank.

If you are our Client you may collect personal data on your End Users. For example,you may ask your End Users for their name and email address in order to send them a personalised playlist. You may also use cookies or other such technologies in order to analyse the usage of your system and control data.

As a Client you are solely responsible for complying with any laws or regulations that apply to your Synchtank system and catalog. You are also responsible for the collection and use of your End Users’ personal data.

You must publish your own privacy policy in order to comply with this.

We are not liable for your relationship with your End Users or how you collect and use their personal data (even that data collected using Synchtank functionality, cookies or other similar technologies) and we will not provide any legal advice on this matter.

Changes to the Policy

This Privacy Policy may be amended from time to time in order to maintain compliance with the law and to reflect any changes to our data collection process. When this Privacy Policy is amended materially, Synchtank will advise their Clients. Synchtank recommends that its users periodically review this Privacy Policy to ensure that they are notified of any updates.
